How to find the right customs tariff number for your goods

A customs tariff number identifies goods for customs purposes. It determines duty rates, import VAT, trade measures, and export requirements. The first six digits come from the Harmonized System (HS), the World Customs Organization standard used by more than 200 countries.

Finding the right code means applying the legal texts of the nomenclature, not searching for keywords. This guide explains the code structure, which texts are binding and which only interpret, the classification process itself, the error patterns that surface in customs audits, and what a wrong code costs.

What do the digits of a customs tariff number mean?

A customs tariff number is built in layers. Each layer adds detail to the classification and serves a different declaration purpose in the EU:

  • Digits 1 to 6: the HS code, harmonized worldwide. Digits 1 and 2 are the chapter, 3 and 4 the heading, 5 and 6 the subheading.
  • Digits 7 and 8: the Combined Nomenclature (CN) of the EU, which carries the EU-wide duty rates, textile categories, and prohibitions and restrictions.
  • Digits 9 and 10: the TARIC code, which carries EU measures such as duty suspensions, anti-dumping duties, and tariff quotas.
  • Digit 11: a national digit, in Germany used for the VAT rate and national prohibitions and restrictions.
  • How many digits you declare depends on the direction: an import declaration in Germany takes the full 11-digit code, an export declaration and Intrastat reporting take 8 digits.

Which texts are binding, and which only interpret

Classification disputes are usually won or lost on which source a decision rests on. The sources are not equal in rank, and most keyword tools quietly ignore the ranking:

  • Legally binding: the wording of the headings and subheadings, the section and chapter notes, and the General Rules of Interpretation (GRI 1 to 6).
  • Legally binding and often decisive: classification regulations issued by the Commission and the judgments of the Court of Justice of the European Union.
  • Authoritative but not binding: the explanatory notes to the HS and to the CN. They interpret the legal texts and carry real weight in an audit, but they cannot override a heading text.
  • Evidence only: BTI decisions issued to other companies, national classification opinions, and the codes your supplier puts on the invoice.
  • No legal value: keyword search results, spreadsheet lookups, and the code a comparable product carried in your last shipment.

How to classify goods step by step

Classification follows a defined legal method, not intuition. A defensible determination works through these steps:

  • Establish the objective characteristics of the goods: material, function, composition, and intended use.
  • Apply the General Rules of Interpretation (GRI 1 to 6) in order, starting with the wording of headings and the section and chapter notes.
  • Check the legal notes and, where helpful, the explanatory notes to the HS and CN for guidance on borderline cases.
  • Verify the candidate code in the EU tariff databases (TARIC) or the national tariff to confirm measures and footnotes.
  • Compare with binding tariff information (BTI) issued for similar goods to validate the result.
  • Document the reasoning, the sources, and the decision so the classification survives a customs audit.

Four error patterns that surface in customs audits

The same mistakes recur across industries, and each of them is visible in a product list long before an auditor arrives:

  • Taking the supplier's code. Only the first six digits are internationally harmonized. Beyond them a third-country code says nothing about the correct EU classification, and the declarant carries the liability either way.
  • Living in the residual subheadings. A catalog where most items sit under an "other" subheading is usually a catalog that was never classified, only assigned.
  • Classifying sets by their most expensive part. Goods put up in sets for retail sale are classified under GRI 3(b) by the component that gives them their essential character, which is frequently not the costliest one.
  • Letting master data age. The Combined Nomenclature changes every 1 January. Codes that were correct when they were entered quietly become invalid, and a declaration with a lapsed code is rejected or corrected at the border.

What a wrong customs tariff number actually costs

The customs tariff number drives almost every downstream customs obligation: the duty rate, anti-dumping exposure, preferential treatment, licensing requirements, and the compliance regimes that hang off the code, such as CBAM, EUDR, and dual-use controls.

Under Article 103 of the Union Customs Code, customs authorities can notify a customs debt for three years after it was incurred. Where the debt results from an act that can give rise to criminal proceedings, member states may extend that period, within a range of five to ten years.

A worked example: on two million euros of annual imports, a code carrying 2.7 percent duty instead of a duty-free code is 54,000 euros a year, and 162,000 euros across a three-year recovery, plus interest. Where an anti-dumping duty was missed the arithmetic is harsher, because those rates commonly run into double-digit percentages. Import VAT is usually neutral for a business entitled to deduct it; the duty never is.

Systematically documented classification decisions are the best protection during an audit. The reasoning matters as much as the code: an auditor who can follow how you reached a heading treats a mistake very differently from one who finds no reasoning at all.

Can I use the customs tariff number my supplier provides?
